Terms and Conditions for SMS Communications & Consumer Consent

1. Introduction These Terms and Conditions ("Terms") govern your use of SMS communications provided by Twisted Coastal RV ("we," "us," or "our"). By opting in to receive SMS communications, you agree to abide by these Terms.

2. Consumer Consent and Opt-In Requirements

• By providing your phone number and explicitly opting in, you consent to receive SMS messages from us, including promotional, transactional, and alert notifications.
• Consent is obtained through a clear and conspicuous disclosure, and you must affirmatively opt-in before receiving any SMS communications.
• You may be required to confirm your opt-in via a reply message or other verification method as mandated by law.
• Message frequency varies based on your interactions with our services.  There is no regular scheduled interval messages. 

3. Opt-Out and Unsubscribe Mechanism

• You may opt-out of SMS communications at any time by replying "STOP" to any message received.
• After opting out, you will no longer receive further messages from us unless you re-subscribe.
• For assistance, reply "HELP" to receive support instructions.

4. Message and Data Rates

• Message and data rates may apply depending on your mobile carrier plan.
• We are not responsible for any charges incurred by your mobile carrier as a result of receiving our SMS communications.
• Message frequency is dependent on services being provided.  We communicate with our customers about scheduling, staff status and job status, and invoice status.   Users can expect to receive messages approximately once a week.  We do not send out unsolicited spam messaging.  

5. User Responsibilities

• You must provide accurate and valid contact information when opting in.
• You acknowledge that SMS messages may be delayed or undelivered due to mobile network issues, which are outside our control.
• You must be at least 18 years old or have parental consent to subscribe to our SMS services.

6. Privacy and Data Security

• We collect and process personal information in accordance with our Privacy Policy.
• We implement appropriate security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction.

7. Service Availability and Modifications

• We reserve the right to modify or terminate SMS communications at any time without prior notice.
• We are not responsible for any delays or failure in SMS message delivery due to factors beyond our control, including network congestion or carrier issues.

8. Limitation of Liability

• We shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or in connection with your use of our SMS services.
• You agree to indemnify and hold us harmless from any claims, damages, or expenses resulting from your breach of these Terms.

9. Changes to These Terms

• We may update these Terms periodically. Any changes will be communicated by updating the "Effective Date" at the top of this page.
• Your continued use of our SMS services after changes are made constitutes acceptance of the revised Terms.
